Terms of Service

These terms cover your use of Top Banana. By creating an account or building a site, you’re agreeing to them.

The service

Top Banana lets you describe a website in plain English and an AI agent builds it as static HTML, hosted under a subdomain or your own custom domain. Sites are static-only: no databases, no server-side code beyond a small set of template-provided functions.

Your account

One passkey-bound account per person. Passkeys can’t really be shared — please don’t try. Don’t impersonate someone else when you sign up.

Your content, your responsibility

You’re responsible for the prompts you submit and the sites those prompts produce. Don’t use Top Banana to host or publish:

• illegal content;
• malware, phishing pages, or scams;
• spam;
• harassment or targeted abuse;
• content that infringes someone else’s copyright, trademark, or privacy.

Acceptable use

• No automated scraping or abuse of the build API.
• Respect quotas. They exist so one account can’t starve the rest.
• Don’t try to break out of the sandbox, attack other tenants, or probe for vulnerabilities. Responsible-disclosure reports to hello@topbanana.dev are welcome.

Who owns what

• Your output is yours. The HTML, CSS, JavaScript, and uploaded assets that make up your site belong to you. You can export them, take them elsewhere, and we have no claim on them.
• The platform is ours. The Top Banana name, logo, source-available platform code, and templates belong to us or the upstream open-source projects we depend on.

About AI-generated output

The build agent is an AI. It will sometimes write code that’s wrong, ugly, insecure, or that hallucinates a feature you didn’t ask for. Review the result before you ship a site to a real audience. We don’t guarantee correctness or fitness for any particular purpose.

Availability

Best effort. We may rate-limit, change quotas, or take the service down for maintenance. We’ll try to give notice for planned downtime.

Termination

You can delete your account at any time by emailing hello@topbanana.dev. We can suspend or close accounts that break these terms — we’ll tell you why, and we’ll give you a chance to export your sites unless the violation makes that unsafe.

No warranty

Top Banana is provided “as is.” We make no warranties, express or implied, about availability, accuracy, or fitness for any particular purpose.

Limitation of liability

To the extent allowed by law, our total liability to you for anything related to the service is limited to the amount you’ve paid us in the prior twelve months (which, for a free account, is zero).

Changes

If we make a material change to these terms, we’ll surface it before it takes effect. The “last updated” date above always reflects the most recent revision.
